What is the difference between a Trust and a Will?
A Trust is a document that reflects a legal arrangement where a person or persons place assets in a Trust . The Trustee administers the Trust according to the rules in the Trust. A Trust takes effect as soon as it is created. It is meant to avoid probate.
A Will is a document that takes effect after death. It appoints a legal representative who carries out your wishes as to who will receive your property. Wills may have to go through probate.
A Trust is more expensive than a Will because it is more complex.
How do I know whether I should have a Will or a Trust?
You should sit down with an attorney to discuss your own situation. Such a decision depends on your own circumstances. The size of your estate, whether this is a second marriage, and whether there are minor children, are only a few of the topics that are explored to help with the decision as to whether a Will or a Trust would be best.
What are power of attorney documents?
Power of attorney documents are commonly done for financial or medical reasons. They allow a person to appoint someone they trust to make decisions in these areas if the person ever becomes incapacitated and unable to do it for him or herself. These are legal documents meant to avoid needing to go to court if a person becomes incapacitated. See an attorney for more information.
